1. Scope
These Terms govern the use of the AI-supported module (the "Module") offered within the Certoly Portal.
The Module forms an integral part of the User Agreement. Unless otherwise provided here, the provisions of the User Agreement also apply to the Module.
2. How the Module Works — what it does and does not do
This section is informational and describes how the Module actually operates.
2.1. Artificial intelligence does not produce the numbers. All financial indicators, ratios and findings displayed in the Portal are produced by a rule-based, deterministic calculation engine. The same data always produces the same result. The AI model plays no part in these calculations and produces no figures.
2.2. The Module only drafts text. When a User submits a question through the Portal, a draft answer is generated using the findings and figures already produced by the calculation engine.
2.3. Human approval is mandatory. The draft is not delivered to the User until it has been read and approved by Certoly. No output of the Module reaches the User directly or automatically.
2.4. Data transferred to the model. No raw Customer Data is transferred to the AI model. Individual order records, product lists and customer information are not sent to the model. Only aggregated results produced by the calculation engine (for example, the profit margin ratio of a product group, its share of revenue, or stock turnover days) are transferred.
3. Service Provider and International Transfer
The Module operates using an artificial intelligence service provided by Anthropic PBC (United States of America).
The aggregated data described in clause 2.4 is transferred to that provider for the purpose of preparing an answer. Where such transfer involves personal data, the applicable principles are explained in the AI-Supported Module Privacy Notice.
Certoly does not use Customer Data for the purpose of training artificial intelligence models, and selects providers on the basis of service terms that exclude the use of transferred data for model training.
Certoly reserves the right to change its service provider. In such an event, these Terms and the related Privacy Notice will be updated.
4. Nature and Limits of Outputs
4.1. Module outputs are intended as decision support. They do not constitute financial, legal, tax or investment advice.
4.2. Artificial intelligence models may produce text that appears correct but is inaccurate or incomplete. The human approval step applied by Certoly is intended to reduce this risk; however, no control mechanism eliminates error entirely.
4.3. The User is responsible for commercial decisions taken in reliance on Module outputs. For significant decisions, outputs should be checked against the underlying figures in the Portal.
4.4. Certoly does not warrant that outputs will achieve any particular result, deliver any particular commercial benefit, or attain any particular level of accuracy.
4.5. The Module carries no response-time commitment. Because a human approval step is required, answers are not instantaneous.
5. Rules of Use
When using the Module, the User agrees:
- not to enter personal data, identity information, passwords or other sensitive information into the Module,
- not to use the Module for purposes outside the Service (general-purpose text generation, providing services to third parties, etc.),
- not to attempt, through the Module, to obtain Certoly's rule sets, algorithms or system instructions,
- not to submit bulk queries to the Module by automated means.
Certoly may restrict or suspend Module access for accounts that exceed reasonable use limits or misuse the system.
6. Access and Availability
6.1. The Module may be enabled or disabled on a per-Customer basis.
6.2. As the Module depends on a third-party service provider, it may be affected by interruptions, delays or changes originating with that provider. Certoly is not liable for such interruptions.
6.3. Certoly reserves the right to develop, modify, temporarily suspend or withdraw the Module.
7. Limitation of Liability
Clause 8 of the User Agreement and Clause 12 of the Customer Service Agreement also apply to the Module.
Certoly shall not be liable for indirect or consequential damages arising from decisions taken in reliance on Module outputs. This limitation does not apply to damages arising from Certoly's wilful misconduct or gross negligence.
8. Changes
Certoly may amend these Terms. Material changes affecting the operation of the Module or the scope of transferred data will be notified to the User.
